Separation

No formal process is required. The date of separation matters for property and divorce purposes. You can be separated while still living under the same roof.
Divorce and separation

Divorce

You must be separated for at least 12 months before applying. Divorce ends the marriage — it does not resolve property or parenting matters. Those are dealt with separately.

What about property division?

Property settlement is separate from divorce and can be negotiated prior to the divorce.

This includes determining how assets, liabilities, and financial resources are separated.

Do we need to go to court?

How much does separation cost?

Do I need a divorce?

It depends on your situation.

You can separate from your spouse without formally applying for a divorce, and many couples remain separated for some time before taking that step.

However, if you intend to remarry, you must first obtain a divorce.

We can help you understand whether applying for a divorce is appropriate based on your circumstances.

What are the impacts of a divorce on my will?

Divorce can affect your existing will.

In many cases, provisions relating to a former spouse may no longer apply following a divorce. However, this does not automatically create a new Will, and other parts of your estate planning may remain unchanged.

It is important to review and update your Will after separation or divorce to ensure it reflects your current intentions.

Am I eligible to obtain a divorce?

In Australia, there are a number of criteria's to ensure you can get divorced.

You will need to prove you have been legally married. Either you or your partner are an Australian citizen. You have resided in Australia for the last 12 months.

You and your ex partner have been legally separated for a minimum of 12 months.
